*These terms and conditions are effective as of March 31, 2020.

Article 1 Scope of Application

  1. The Accommodation Contract and related agreements concluded by Nishijin Fujita (hereinafter referred to as “the Inn”) with its Guests shall be in accordance with the provisions of these General Terms and Conditions, and all matters not provided for in these General Terms and Conditions shall be in accordance with local laws and regulations or generally established customs.
  2. Notwithstanding the preceding paragraph, if the Inn agrees to a special arrangement that does not conflict with any law or custom, then the special arrangement shall prevail.

Article 2 Application for Accommodation Contract

  1. A person who wishes to apply for a contract for accommodation at the Inn is requested to provide the following information to the Inn.
    1. Name
    2. Date of stay and estimated time of arrival
    3. Room charge (in principle, based on the basic room charge in Appendix 1)
    4. Other matters deemed necessary by the Inn or government bodies.
  2. In case the Guest requests during his/her stay to extend his/her stay beyond the period of stay specified in Item 2 of the previous paragraph, the Inn shall treat such a request as a new application for a Contract of Stay at the time such request is made.

Article 3 Formation of Accommodation Contract

  1. The Accommodation Contract shall be concluded when the Inn accepts the application described in the previous article. This does not apply if the Inn proves that it has not given its consent.
  2. When the Accommodation Contract has been concluded pursuant to the provisions of the preceding paragraph, an application fee determined by the Inn, which is limited to the basic accommodation charge, shall be paid by the date designated by the Inn.
  3. The deposit shall first be applied to the room charge ultimately payable by the Guest, and in the event that the provisions of Articles 6 and 18 apply, the deposit shall be applied in the order of penalty charges, followed by compensation, and any remaining amount shall be returned at the time of payment of the charges pursuant to Article 12.
  4. If the application fee stipulated in Paragraph 2 is not paid by the date specified by the Inn in accordance with the provisions of the said Paragraph, the Accommodation Agreement shall cease. This shall apply only if the Inn has notified the Guest of this when setting the date for payment of the application fee.

Article 4 Special Agreement Requiring No Payment of Application Fee

  1. Notwithstanding the provisions of Paragraph 2 of the preceding article, the Inn may accept a special agreement that does not require payment of the application fee as specified in the preceding paragraph after the Contract is concluded.
  2. In the event that the Inn does not request payment of the application fee as specified in Paragraph 2 of the preceding article or does not specify the date for payment of said application fee, the Inn will treat the application as having complied with the special provisions of the preceding paragraph.

Article 5 Refusal to Enter into Accommodation Agreement

The Inn may refuse to conclude an Accommodation Contract in the following cases:

  1. When the application for accommodation is not in accordance with these Terms and Conditions;
  2. When it is impossible to provide a room due to full occupancy;
  3. When it is recognized that the individual seeking accommodation is likely to conduct himself/herself in a manner contrary to the provisions of laws and regulations, public order, or good morals with respect to the accommodation;
  4. When it is recognized that the individual seeking accommodation falls under any of the following points, a through c:
    • a. The person is a member of Boryokudan (organized crime group) as defined in Article 2, Paragraph 2 of the Act on Prevention of Unjustifiable Acts by Organized Crime Groups (Act in Japan), those as defined in Article 2, Item 6 of the same law, a quasi-organized crime group member or person related to organized crime groups, and other anti-social forces; or
    • b. The person is a member of corporations whose business activities are controlled by Boryokudan or Boryokudan members or other similar organizations; or
    • c. The person is a member of a corporation which includes Boryokudan members in its employment.
  5. When the individual seeking accommodation uses language or behavior that causes significant inconvenience to residents in the neighborhood.
  6. When it is clearly recognized that the individual seeking accommodation is suffering from a contagious disease.
  7. When an unreasonable demand, possibly accompanied by violence or threatening behavior, is made in connection with the accommodation.
  8. When accommodation is not possible due to natural disasters, breakdown of facilities, or other unavoidable circumstances.
  9. Other cases which fall within the situations stipulated in Article 5 of the Kyoto Prefectural Ordinance of the Hotel Business Act.

Article 6 Guest’s Right to Terminate Contract

  1. The Guest may cancel the accommodation contract by making a request to the Inn.
  2. In the event that the Guest cancels all or part of the accommodation contract due to reasons attributable to the Guest, the Inn shall charge a penalty fee for cancellation in accordance with the provisions listed in Appendix 2. This does not apply, however, if the Inn has specified the due date for payment of the application fee and requested payment thereof pursuant to Article 3, paragraph 2, and the Guest has canceled the accommodation contract prior to the due date pf such payment. Furthermore, if the Inn accepts the special agreement referred to in Article 4, Paragraph 1, the penalty fee shall be charged only if the Inn has notified the Guest of the obligation to pay the penalty fee for cancellation of the contract.
  3. If the Guest does not arrive at the Inn by 8:00 p.m. on the day of the stay (or two hours after the estimated time of arrival, if such time has been indicated in advance), the Inn may treat the contract as having been cancelled by the Guest.

Article 7 The Inn’s Right to Terminate Contract

  1. The Inn may cancel the accommodation contract in the following cases:
    1. When it is recognized that the Guest is likely to conduct himself/herself in a manner contrary to the provisions of laws and regulations, public order, or good morals with respect to the accommodation, or when it is recognized that the Guest has committed such an act;
    2. When it is recognized that the Guest falls under any of the following points, a through c:
      • a. The person is a member of Boryokudan (organized crime group), quasi-organized crime group member or person related to organized crime groups, and other anti-social forces; or
      • b. The person is a member of corporations whose business activities are controlled by Boryokudan or a Boryokudan member or other similar organizations; or
      • c. The person is a member of a corporation which includes Boryokudan members in its employment.
    3. When the Guest uses language or behavior that causes significant inconvenience to residents in the neighborhood.
    4. When it is clearly recognized that the Guest is suffering from a contagious disease.
    5. When an unreasonable demand, possibly accompanied by violence or threatening behavior, is made with respect to the accommodation.
    6. When accommodation is not possible due to natural disasters or other unavoidable reasons.
    7. Other cases which fall within the situations stipulated in Article 5 of the Kyoto Prefectural Ordinance of the Hotel Business Act.
    8. When the Guest does not comply with the prohibitions (limited to those necessary for fire prevention) of the rules of use established by the Inn, such as smoking in a guest room or bedroom, using firearms, or tampering with fire-fighting equipment.
  2. In the event that the Inn cancels the accommodation contract pursuant to the preceding paragraph, the Inn does not charge any accommodation fee for the services that were not provided to the Guest.

Article 8 Accommodation Registration

On the day of the stay, the Guest is requested to provide the following information at the Front Desk of the Inn:

  1. Name, gender, age, address, nationality, and occupation
  2. For guests from foreign countries, nationality, passport number, place of entry and date of entry (we will make a copy of your passport when you check in).
  3. For Japanese guests, ID information (insurance card or driver’s license) (we will print it out or take a picture of it.)
  4. Other information which the Inn deems necessary.

Article 9 Room Usage Hours

  1. Guests may use their rooms from 3:00 p.m. on the day of arrival until 11:00 a.m. on the day of departure.
  2. Notwithstanding the provisions of the preceding paragraph, the Inn may accept the use of the rooms after the check-out time stipulated in the preceding paragraph. In such cases, the following additional charges shall apply:
    1. 30% of the room charge for up to 3 hours excess
    2. 50% of the room charge for up to 6 hours excess
    3. 100% of the room charge for greater than 6 hours excess

Article 10 Adherence to Rules of Use

During their stay, Guests shall follow the rules of use which the Inn has established and posted.

Article 11 Operation Hours

The principal opening hours are as follows:

  1. 24 hours
  2. The hours stated in the preceding paragraph may be changed temporarily in case of unavoidable circumstances. In such cases, notification will be provided by appropriate means.

Article 12 Payment of Accommodation Charges

  1. The breakdown of accommodation charges to be paid by Guests shall be in accordance with Article 18, Appendix 1.
  2. The payment of the accommodation charges stated in the preceding paragraph must be made at the front desk prior to the Guest’s stay. This can be done when the Guest arrives at the Inn or when the Inn charges the Guest. The Inn accepts cash, credit cards, and other alternative payment methods.
  3. The Inn will charge a room charge even if the Guest voluntarily does not stay in the room after the Inn has made the room available for the Guest to use.

Article 13 Responsibility of the Inn

  1. The Inn will compensate for any damages caused to the Guest in the fulfillment of an accommodation contract and related agreements, or in the event of non-fulfillment of such agreements. This shall not apply, however, if the damages are not caused by reasons attributable to the Inn.
  2. The Inn maintains adequate insurance coverage for hotels to safeguard against potential risks, including fire and other emergency scenarios.

Article 14 Handling when Contracted Rooms are Unavailable

  1. In the event that the Inn is unable to provide a Guest with a contracted room, the Inn shall, with the consent of the Guest, arrange other accommodation under the same conditions as far as possible.
  2. If, notwithstanding the provisions of the preceding paragraph, the Inn is unable to find other accommodation, it will pay the Guest a compensation fee equivalent to the amount of the penalty, which will be applied to the amount of compensation for damages. However, if there is no reason attributable to the Inn for not being able to provide the Guest with a room, no compensation shall be paid.

Article 15 Handling of Deposit

The Inn will not keep any items, cash or valuables brought to the accommodation premises by Guests.

Article 16 Storage of Baggage or Personal Belongings of Guests

  1. The Inn generally does not accept Guest’s baggage that arrives before the Guest’s arrival.
  2. In the event that a Guest’s baggage or personal belongings are left at the Inn after the Guest has checked out and the owner is found, the Inn shall contact the owner and request instructions from him or her. The Inn will keep the baggage or personal belongings for 20 days including the day of discovery, but will dispose of them if the owner’s instruction is not received within that period, or if the owner is not located.
  3. The responsibility of the Inn for the storage of the Guest’s baggage or personal belongings in the case of paragraph (2) shall be in accordance with the provisions of the preceding article.

Article 17 Parking Responsibility

When a Guest uses the parking lot of the Inn, the Guest is required to acknowledge that the Inn rents only the space of the parking lot, and shall not be liable for vehicle management.

Article 18 Guest’s Responsibility

In the event that the Inn suffers damages due to an intentional or negligent act of a Guest, the said Guest shall compensate the Inn for such damages.
